WEST PALM BEACH, Fla. (CBS12) — Florida Attorney General James Uthmeier is asking a judge to rein in ChatGPT, seeking to block minors from the platform and restrict how OpenAI develops, markets and operates its artificial intelligence products.
Uthmeier announced Monday that his office filed a motion for a temporary injunction in Highlands County Circuit Court against OpenAI, CEO Sam Altman and several entities affiliated with the company.
In a video posted to Uthmeier's X account, he said, “Stop calling it safe. Stop pretending it's human. Stop selling it to kids.”

The 49-page motion asks the court to temporarily prohibit OpenAI from developing new artificial intelligence models without independent third-party safety guardrails and approval.
Florida is also asking the court to:
- Prohibit ChatGPT from being offered to minors in Florida.
- Restrict the collection and processing of personal information from children under 13 without parental consent and other safeguards.
- Prevent OpenAI from representing ChatGPT as safe, reliable or accurate without warnings about what the state alleges are risks and inaccuracies.
- Prevent ChatGPT from presenting itself as having human characteristics, including suggesting it can think, feel or experience emotions.
- Prohibit ChatGPT from soliciting continued engagement from users through what the state calls “conversation prolongation.”
If granted, the temporary injunction would impose broad restrictions on how OpenAI develops and operates its artificial intelligence products and how ChatGPT interacts with users in Florida while the lawsuit continues.
The request comes nearly four months after Uthmeier's office filed its lawsuit against OpenAI on June 1. The state alleges OpenAI violated Florida's Deceptive and Unfair Trade Practices Act, was negligent in the design and marketing of ChatGPT, failed to warn Floridians of alleged dangers associated with the product and created a public nuisance. plaintiffs_motion_for_temporary
According to Monday's motion, OpenAI moved the case to federal court before a federal judge determined the requirements for federal jurisdiction had not been met. The case was then returned to Highlands County Circuit Court.
“If Sam Altman meant what he said about slowing down, he can join our ask to the court,” Uthmeier said. “If he will not, we ask the court to do what OpenAI will not do for itself. Protect Florida families.”
The motion represents Florida's allegations and request for temporary relief. A judge has not ruled that OpenAI violated the law or granted the restrictions sought by the state.
